Which rules may apply?
Australian healthcare practices need to understand their obligations under the Privacy Act 1988 and Australian Privacy Principles, including APP 11 security safeguards. Health service providers handling health information are generally covered by the Privacy Act even when they are small businesses. State or territory health privacy requirements may also apply. The exact obligations depend on the practice, activities and jurisdiction.
What does APP 11 mean in practice?
APP 11 requires reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Reasonable steps are context-dependent. Common assessment topics include multi-factor authentication, least-privilege access, patching, backups, logging, vendor access and secure disposal of records.
What about My Health Record?
Practices participating in My Health Record should separately review their participation and security obligations, including applicable policies, access controls, training and incident response. Do not assume that an APP 11 review alone demonstrates My Health Record compliance.
How should a practice prepare?
Identify where patient data is stored and shared; document system owners and service providers; review access to clinical systems; test backup restoration; maintain an incident response plan; and record remediation actions with owners and target dates.
What can a cybersecurity assessment establish?
An independent review can identify evidence gaps and technical weaknesses and produce a prioritised improvement plan. It is not automatically a legal opinion, regulatory certification or guarantee of compliance.
